Main provisions of the GlüStV
There are plenty of special provisions that are established to regulate the online gambling sector within the country. The most important one is always the age restrictions to participate in these online activities. Article 4(3) of the GlüStV establishes that only persons who are 18 or older are allowed to participate in online gambling. They also require that operators implement systems to verify their age upon registration.
Another sore point when it comes to online gambling is the participation of athletes in gambling activities. This is covered in Article 73(1) of the GlüStV. All active professional athletes are forbidden to participate in events where they participate or in any discipline in which they have taken part in the last six months.
In a solid effort to minimize the negative impact that gambling might have on the population, operators need to enforce actions to avoid or at least reduce the potential harm done by gambling in the population. Among these measures, they must verify the identity and the age of every player who wants to participate in online activities. To prevent significant damage to personal finances, there must be deposit limits. They must implement deposit limits for all players.
They must follow a protocol for self-excluded players. Operators must honor the players' desire to be excluded from the game for as long as they want. When exclusion periods are complete, they should implement cooling periods as well. Operators need to provide easy access to players when they need help to overcome gambling problems. The safety of the players is above the revenue.
In the same way, the country enforces restrictions on gambling. Any marketing should not be designed to appeal to minors and must not be displayed in channels where minors could be part of the audience. Such advertising must not be displayed in places like schools or public transportation. Also, advertising must not be designed to take advantage of vulnerable persons that might affect people struggling with gambling problems.
